Work Visa

Work visas are one of the most common ways that foreign workers and others can remain lawfully present in the United States. If you want to come to the U.S. to work or visit, or your company needs to bring in skilled labor, The Sheena Law Firm will work with you to obtain a temporary work visa.

Permanent Work Visa

An immigrant is a foreign national who is authorized to live and work permanently in the United States as a Lawful Permanent Resident. You must go through a multi-step process to become an immigrant based on employment. The USCIS must approve an immigrant petition application that was filed for you, usually by an employer.

Under U.S. immigration laws, there are four basic categories of work visas:

  • EB-1 - work visas are for foreign citizens (1) with extraordinary abilities in the arts, sciences, education, business or athletics; (2) who are outstanding professors or researchers; or (3) who are executives or managers working outside the United States for a U.S. company.
  • EB-2 - work visas are for foreign citizens with advanced degrees or exceptional abilities in the arts, sciences or business
  • EB-3 - work visas are for skilled or professional workers.
  • EB-4 - work visas are for foreign citizen religious workers and employees and former employees of the United States government.

If you have specific skills related to business management, computers, technology, cooking, or religious work, a company or organization may wish to sponsor you on an H-1, L-1, E-1 work visa, or labor certification process.

Work Visas

  • H-1B Visas - Persons working in specialty occupations requiring at least a bachelor's degree or its equivalent in on-the-job experience, and distinguished fashion models

  • H-2A Visas -Temporary agricultural workers coming to the U.S. to fill positions for which a temporary shortage of American workers has been recognized by the U.S. Department of Agriculture.

  • H2B Visa - Temporary workers of various kinds coming to the U.S. to perform temporary jobs for which there is a shortage of available, qualified American workers.

  • H-3 Visas - Temporary trainees coming for on-the-job training unavailable in their home countries. Temporary trainees coming for on-the-job training unavailable in their home countries.

  • L-1 Visas - Intercompany transferees who work as managers, executives, or persons with specialized knowledge.

  • TN Visas - Work visas for Canadians and Mexicans under the NAFTA free trade agreement.
