Immigration Appeals

Immigration cases can be appealed to the Board of Immigration Appeals, on to the federal courts and all the way to the Supreme Court of the United States. When you or a loved one has received a final order of removal, when your request to change or extend your visa status has been denied, or your asylum application has been denied, an appeal may be possible.

An "appeal" is a formal request that a "higher" body review the action, procedure, or decision of a lower court, administrative agency, or other body.  One can file an appeal if the lower authority made an error of law or fact or if something occurred to make the proceedings before the lower authority unfair.

Under certain circumstances, you may ask the Immigration Judge or the BIA to review the case again. A Motion to Reopen or Reconsider is filed with the court that last heard the case.

A Motion to Reopen may be granted if you can show one of the following:

  • New facts or evidence
  • Changed country conditions
  • Lack of notice
  • Exceptional circumstances
  • Ineffective assistance of counsel

Should your appeal be denied by an immigration judge you have 30 days to file an appeal with the board of immigration appeals. An unfavorable decision from the board of immigration appeals must be appealed to the Federal Court of Appeals with jurisdiction over your case within 30 days.
