Consular Processing

Consular Processing is the process that allows foreign nationals to visit or immigrate to the United States. Persons who are outside the U.S. or persons who are in the U.S. but prefer processing at a U.S. consulate for strategic or convenience reasons need Consular Processing as well.

There are 3 types of immigrant visa categories:

  • Diversity Visa - Lottery
  • Employment based immigration
  • Family based immigration

Throughout the world United States consulates accept applications for immigrant and non-immigrant visas. Each one follows its own procedures and guidelines.

If an alien chooses to apply for Consular Processing, he must go back to the country of last residence or country of birth for an interview and medical exam at a U.S. consulate.

The time frame for Consular Processing is quicker than Adjustment of Status. From the date immigrant visa numbers become available, an average of 5 to 13 months processing time is expected. Consular Processing must process in the foreign country of residence or country of birth.


You need the following documents for Consular Processing:

  • Original I-797 approval notice for your I-130 or I-140 immigrant petition.
  • Consular Processing application forms.
  • A copy of the immigrant petition as filed.
  • The receipt notice for Form I-824 or the approval notice for Form I-824.
  • Medical exam.
  • Birth Certificate.
  • Passport.
  • Military Records, if applicable.
  • Marriage Certificates, if applicable.
  • Documentation of termination of prior marriages, if applicable.
  • Evidence that your last residence was in the host country of the embassy or consulate.
  • Employment information for the past 10 years.
  • Address since the age of 16.
  • Police certificates from every country where you have resided for one year or more since the age of 16.
